Conditions of use
Last updated 23 September 2026 · includes the aviso legal as §1
Written in Spanish and in English. If the two disagree, the Spanish text is the one that counts.
These terms govern the use of every GymAI service: the website gymai.coach, gym accounts and the gym listing, the GymAI app, professional and organisation accounts, paid plans, and the instances we run for customers. They are written once for the whole platform. A section about a service applies from the day that service opens to you; the services open today are listed at gymai.coach/legal/services.
How we handle personal data is explained in the Privacy policy, which is part of these terms.
1. Legal notice — who we are
GymAI is provided by:
- José Conti Calveras, sole trader
- NIF: ES46745383E
- Address: Avenida República Argentina 190, 4.º 2.ª, 08023 Barcelona, Spain
- Email: j.conti@joseconti.com
(Information required by article 10 of Spain's Law 34/2002 on information-society services, LSSI-CE.)
Single point of contact (articles 11 and 12 of the Digital Services Act, Regulation (EU) 2022/2065): for users and for the authorities of the Member States, the Commission and the Board, j.conti@joseconti.com. We answer in Spanish, Catalan and English. Messages are read by a person, not only by automated means.
2. Accepting these terms
By creating an account, or by using a service that requires one, you accept these terms. If you use GymAI on behalf of a business or organisation, you accept them for that business or organisation and confirm you are authorised to do so.
Consumers and businesses. Some sections apply differently to consumers (people acting outside their trade or profession) and to businesses. Nothing in these terms limits the rights a consumer has under Spanish or European consumer law.
3. Accounts
- Age. You must be 18 or over to open a gym, professional or organisation account, or to pay for a plan. App accounts for younger people follow the age rules of the law that governs the account: below the age of consent (14 in Spain), a person can only join with the consent of a parent or guardian, through a family group the guardian administers.
- Accurate details. Give true information and keep it current. The email address on your account must be yours and must be confirmed.
- One person, one account. Accounts are personal. Do not share your credentials or let others use your account. An organisation adds each person who manages it with their own access.
- Security. Keep your password, passkeys and authenticator safe, and tell us at once if you suspect someone else has used your account. Some actions, such as editing a gym record, require a second factor.
- No recovery by the operator. For your protection, we cannot hand an account to someone who cannot prove access to it through the ways it offers.
4. The gym listing
4.1 What the listing is
The listing describes gyms as businesses: name, address and position, equipment, services, an optional short note on how to find the door, and the gym's website. It exists so people can find where to train and set up their training for the gym they are in. A record never describes a person and never holds members, staff, photos of people, opening hours, prices, ratings or reviews.
Every published fact shows how old it is. A fact nobody has confirmed recently is shown as such, and suggestions are shown as suggestions, not as statements.
4.2 Adding and correcting gyms
Anyone with a confirmed account may add a gym or propose corrections. When you do, you confirm that:
- the gym exists and what you describe is true, to the best of your knowledge;
- you describe only the business, never a person, and include no one's personal data;
- you use only the values offered (equipment and services come from our lists; brands are not recorded);
- a free-text note contains only practical directions to the entrance.
Before a new gym is saved, we show you any existing records that might be the same gym, and you must confirm it is none of them.
4.3 Claiming a gym
A gym, or someone acting for it, may claim its record to keep it up to date. A claim proves that you control the gym's website or an email address at its domain. It does not prove ownership of the premises, and we never describe a claimed record as "verified owner".
- A person always decides a claim. Proof is required but never grants a claim by itself. We aim to decide within a few days.
- Re-claims. If someone claims a record another account already keeps, the keeper is told and has 14 calendar days to object; an objection made later still counts until the claim has been decided. Nothing is handed over before a person decides.
- Refusals. If your claim is refused, you are told why, using one of our standard reasons. You can claim again with new evidence.
- A claim never erases the record's history.
4.4 How results are ordered (ranking)
- Search by name: matching gyms are listed by town, then street. No gym is highlighted above the others.
- Search by position: gyms are listed by distance, and the distance is shown.
- Nobody can pay for a better position in the gym listing. If we ever offer paid placement, it will be labelled as such wherever it appears, and these terms will describe it before it starts.
- The professional directory never has paid placement.
4.4a Data about your business (P2B)
When a business claims its record, it can see and change the facts of that record and their history, as the record shows them. We do not give other businesses access to data about you. After your business account ends, the facts about the gym stay in the listing as an unclaimed record (the listing describes the gym, not the account), and the data of your account is handled as the Privacy policy says. We do not give you access to data other users provide about their training.
4.5 Accuracy
The listing is built from what gyms and users tell us. We work to keep it accurate and show the age of every fact, but we do not guarantee that a gym has a given machine, service or address at the moment you visit.
5. Rules for everyone
You must not:
- publish anything unlawful, false or misleading, or anything that infringes someone else's rights;
- include personal data of other people, or photographs showing people, anywhere you are not asked for it;
- impersonate a gym, a professional or any other person, or claim a gym you have no right to act for;
- extract the listing or the directory in bulk (by scraping, automated queries or otherwise), or reuse a substantial part of them, without our written permission;
- interfere with the service, probe its security without our permission, or get around its limits;
- use GymAI to send spam or unsolicited messages;
- use the service in a way that could harm minors.
6. Content moderation
Who moderates. The owner of GymAI and the moderators he appoints. Every decision is taken by a person; our tools help us find what to review (for example duplicate names), but no content is removed or hidden by automated means alone.
What we may do, in proportion to the problem:
- refuse or reverse a claim;
- correct a fact, or refuse a proposed one;
- hide a gym record from search and the map, for one of these reasons: it is not a gym; it is a duplicate; the gym has closed; the record does not match the place; or its content is illegal or breaks these terms;
- refuse or close an equipment or exercise request;
- remove a professional from the directory, or remove professional capabilities, if their verification lapses or is revoked;
- suspend or close an account that seriously or repeatedly breaks these terms or the law.
Statement of reasons. When we hide or restrict your content, or suspend your account, we tell you — by email to your confirmed address and in your account — what we did and for how long, the facts and the reason, whether it followed a report or our own review, the rule in these terms or the law it is based on, and how you can challenge it.
Challenging a decision. You can reply to the decision from your account or write to j.conti@joseconti.com, and a person will review the decision again in the light of what you tell us. A hidden record is restored as soon as the reason no longer applies. You can also go to the courts. Out-of-court dispute settlement bodies certified under the Digital Services Act may be available to you.
Businesses (P2B Regulation). If you use GymAI for your business, we tell you the reasons for any restriction or suspension no later than when it takes effect, and we give you at least 30 days' notice before terminating your business account entirely — except where the law requires otherwise, where you have repeatedly broken these terms, or where there is a legal or safety reason not to.
Crimes. If we become aware of information giving rise to a suspicion that a criminal offence involving a threat to someone's life or safety has taken place, is taking place or is likely to take place, we inform the authorities (article 18 DSA).
7. Reporting illegal content
Anyone may tell us about content on GymAI they believe is illegal. Until our in-product reporting form is available to you, write to j.conti@joseconti.com with:
- why you believe the content is illegal;
- exactly where it is (the web address or the gym's name and address);
- your name and email address (not required for reports of child sexual abuse material);
- a statement that you believe, in good faith, that the report is accurate and complete.
We acknowledge receipt, decide promptly, carefully and objectively, and tell you our decision and how to challenge it. Signed-in users can also report a gym record from the record itself when that option is available; the gym is never told who reported it.
8. Your content and our rights
- Your content. The facts you add about a gym are facts about a business; to the extent any of your contributions is protected, you grant us a free, worldwide, non-exclusive licence, for as long as the rights last, to store, adapt, publish and make it available as part of GymAI. You confirm you have the right to grant it. Your training data remains yours and is used only to provide the service to you.
- Our rights. GymAI's software, design, texts, exercise catalogue, images and the database of the listing belong to José Conti Calveras or its licensors. GymAI's source code is available under the GymAI Source-Available Licence, which is not an open-source licence. Maps show data from OpenStreetMap contributors, under the Open Database Licence.
- Some catalogue illustrations are generated with the help of AI and carry a machine-readable mark saying so.
9. Health and safety
This service is not open yet, so nothing here applies to anybody today. It is written so that it is already true on the day it does.
GymAI is not a medical device. It is a tool for general fitness and wellbeing. It does not diagnose, treat, monitor or prevent any disease or injury, and nothing in it is medical advice. Pain notes and questionnaires are personal records; GymAI does not assess them clinically and does not make recommendations from them.
- Before starting or changing an exercise programme, and whenever you have a condition, an injury, pain, or any doubt, ask a qualified health professional.
- Stop exercising if you feel pain, dizziness or discomfort, and seek advice.
- Use equipment you know how to use safely, within your own capacity.
- Exercises marked as clinical or prescription-only are there so that a verified professional can prescribe them; do not apply them to yourself.
10. Professionals
This service is not open yet, so nothing here applies to anybody today. It is written so that it is already true on the day it does.
- Verification. Professional capabilities for regulated health professions are available only after we have checked the relevant public register, and in the countries where we can do that. We re-check once a year. If your registration lapses or is revoked, the capabilities that depend on it end, and your clients keep everything they have.
- Your responsibility. You are responsible for your professional acts, including every plan, exercise or recommendation you give through GymAI, and for complying with the rules of your profession. Being listed or verified on GymAI is not an endorsement by us.
- Your records. If the law requires you to keep records about your clients, you keep them as controller, and GymAI does not replace your record-keeping duties.
- Working with a client's data. You may see and use only what the client has granted you, for the purpose for which it was granted. Every access is logged and visible to the client.
- The directory is free, opt-in, and never sells positions.
11. Paid plans
This service is not open yet, so nothing here applies to anybody today. It is written so that it is already true on the day it does.
This section applies when you buy a paid plan.
- Prices are shown before you buy, including taxes (VAT), with the billing period.
- How to buy. You choose a plan, review a summary of what you are buying and its price, can go back and correct any detail before confirming, and pay. We confirm the purchase by email with these terms attached; we keep a record of the contract, which you can ask us for. The contract can be concluded in English or Spanish.
- Trial. Where a free trial is offered, we tell you its length before it starts and remind you before it becomes paid. You can cancel during the trial and pay nothing.
- Renewal. Plans renew automatically for the same period until you cancel. You can cancel at any time from your account; the plan stays active until the end of the period already paid.
- Right of withdrawal (consumers). You have 14 calendar days from the purchase to withdraw without giving a reason. If you ask for the service to start straight away during that period, and then withdraw, you pay only for the part already provided. Where the law allows the right to be lost once a digital service has been fully provided with your prior express consent, we ask for that consent and your acknowledgement before starting.
- Price changes. We tell you at least 30 days before a new price applies to you; if you do not accept it, you can cancel before it takes effect.
- Payment. Card payments are processed by our bank's payment service (Redsys); we do not see your card number. Purchases made in an app store are governed by that store's terms, including its refunds.
- Invoices are issued to the details you give us.
- Lapsed payment. If a payment fails, you can always sign in to renew, back up, close or delete your account; you never lose access to your own data because of it.
- Referral programme. Where offered, rewards are months of service with no cash value; they cannot be transferred or exchanged for money, and are used only as the programme's rules say. The specific rules are shown with the programme before you take part, and changes apply only to rewards earned after the change.
12. Customer instances
This service is not open yet, so nothing here applies to anybody today. It is written so that it is already true on the day it does.
A gym, clinic, care home, professional or other organisation that pays for its own instance also signs a data-processing agreement with us, under which it is the controller of its members', clients' or patients' data and we act only on its instructions. It is responsible for telling those people how their data is used and who can read it.
13. The free, self-hosted version
The free version that anyone can install on their own server is provided under its own licence. It is not a service we provide: whoever installs it runs it, is responsible for it, and is the controller of its data. We give no support, availability or warranty for it beyond what its licence states.
14. Availability and changes to the service
We work to keep GymAI available and secure, but we cannot promise it will be uninterrupted or error-free. We may change or improve features. If a change removes a feature you pay for or significantly reduces the service, we tell you in advance and, if you are a consumer, you may cancel and receive a proportional refund of the period not used.
15. Liability
- We are liable for damage we cause intentionally or through gross negligence, and for death or personal injury caused by our negligence, without limitation.
- For consumers, we are also liable as consumer law provides; nothing in these terms excludes or limits that liability.
- For business users, and to the extent the law allows, our liability for slight negligence is limited to foreseeable, typical damage, and in any case to the amount you paid us in the 12 months before the event; we are not liable for lost profits or indirect damage.
- We are not liable for content added by users, or for decisions taken by professionals, gyms or other users, except where the law makes a hosting service liable (for example, if we fail to act promptly after gaining actual knowledge of illegal content).
16. Leaving and termination
- You can leave at any time: Delete account removes your account and data at once; Close account keeps them for six months so you can come back, and then deletes them. The Privacy policy explains what is kept after that and why.
- We may end these terms with you for serious or repeated breaches, as described in section 6, or if we stop providing a service — in which case we tell you at least 30 days in advance, let you download your data, and refund any period paid and not used.
17. Changes to these terms
We may change these terms for legal, security or service reasons. We tell you at least 30 days before a change applies (15 days is the minimum for business users under the P2B Regulation; we give 30 to everyone), by email or in your account, explaining what changes. If you do not accept the change, you can close or delete your account before it applies; a business user may terminate immediately. Opening a service these terms already describe is not a change.
18. Law and courts
These terms are governed by Spanish law.
- Consumers may bring proceedings in the courts of their own domicile, and can only be sued there. If you live in another EU country, you keep the protection of the mandatory rules of that country.
- Business users: the courts of Barcelona have jurisdiction.
The European Commission's Online Dispute Resolution platform was closed in 2025, so we do not link to it. We are not obliged to take part in consumer arbitration, and we will tell you if we join a consumer arbitration or alternative dispute resolution body.
19. Languages
These terms are available in English and Spanish. Both versions are equally valid. If they differ, the Spanish version prevails, except that a consumer may rely on the version in their own language where it is more favourable to them.
